A RESOLUTION VACATING AN UNUSED PORTION OF <br />GRANDVIEW PLACE WITHIN THE PLAT OF MOUNT HOME PARR <br />SBCTION 7, TOWNSHIP 117, RANGE 23 IN THE <br />CITY OF ORONO, MINNESOTA <br />FILE NO. 1036 <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, on May 23, 1986, Nancy Ferrell filed a petition <br />with 'the City of Orono requesting the vacation of a portion of <br />Grandview Place originally dedicated in the plat of Mount Home Park <br />legally described as follows: <br />That part of the adjoining West half of vacated Grandview Place <br />lying between the Easterly extensions across it of the North line <br />of Lot 1, Block 4, Mount Home Park and the South line of Lot 8, <br />Block 4, Mount Home Park, Hennepin County, Minnesota; and <br />WHEREAS, after due published and posted notice, a public <br />hearing was held before the City Planning Commission on June 16, 1986, <br />regarding said vacation and all persons interested were given an <br />opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning <br />Commission recommended approval of the requested vacation and the <br />Council of the City of Orono finds that said vacation, as proposed, is <br />in keeping with the public interest in consideration of the following <br />findings: <br />1. The vacation does not affect access to or use of any <br />adjoining property. <br />2. The City has not and does not intend to develop, improve <br />or use the dedicated right-of-way as a road except f <br />utilities and access purposes hereinafter described. <br />3. The unimproved dedicated right-of-way as it exists server <br />no public purpose. <br />NOW, THEREFORE, BE IT RESOLVED, that the petition of Nancy <br />Ferrell is hereby granted and that the portion of Grandview Place <br />legally described above is hereby vacated.
