A RESOLUTION VACATING AN UNUSED PORTION OF GRANDVIEW PLACE WITHIN THE PLAT OF MOUNT HOME PARR SBCTION 7, TOWNSHIP 117, RANGE 23 IN THE CITY OF ORONO, MINNESOTA FILE NO. 1036 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, on May 23, 1986, Nancy Ferrell filed a petition with 'the City of Orono requesting the vacation of a portion of Grandview Place originally dedicated in the plat of Mount Home Park legally described as follows: That part of the adjoining West half of vacated Grandview Place lying between the Easterly extensions across it of the North line of Lot 1, Block 4, Mount Home Park and the South line of Lot 8, Block 4, Mount Home Park, Hennepin County, Minnesota; and WHEREAS, after due published and posted notice, a public hearing was held before the City Planning Commission on June 16, 1986, regarding said vacation and all persons interested were given an opportunity to be heard; and WHEREAS, after due standing and consideration, the Planning Commission recommended approval of the requested vacation and the Council of the City of Orono finds that said vacation, as proposed, is in keeping with the public interest in consideration of the following findings: 1. The vacation does not affect access to or use of any adjoining property. 2. The City has not and does not intend to develop, improve or use the dedicated right-of-way as a road except f utilities and access purposes hereinafter described. 3. The unimproved dedicated right-of-way as it exists server no public purpose. NOW, THEREFORE, BE IT RESOLVED, that the petition of Nancy Ferrell is hereby granted and that the portion of Grandview Place legally described above is hereby vacated.
