Marvel Sewer and Drain, LLC (hereafter “Contractor”) shall furnish all of the materials and perform all of the work as agreed to in the <br />attached Proposal as it pertains to work to be performed on the property listed above. If the Proposal provided is not accepted by the client <br />within 30 days of receipt it can be withdrawn by Contractor. <br />2. Pricing & Changes: Costs associated with this project will be as provided in the attached Proposal. Changes to the scope of work may <br />result in additional charges. Alteration or deviation from the Proposal involving costs greater than one thousand dollars ($1,000.00) of the <br />total Proposal amount requires written approval from the Client. Any unwritten changes made to the scope of work will be billed at rates <br />consistent with the accepted Proposal. <br />3. Client Responsibilities: Client is responsible for complying with and notifying Contractor of all covenants and/or restrictions applicable to <br />the property along with obtaining any necessary prior approval from private entities including but not limited to: homeowner’s associations, <br />management companies, etc. Contractor is not responsible for surveying the property or determining boundary lines, easements, or <br />encroachments located on the property. All aforementioned items in this clause are the responsibility of the Client. Contractor is not <br />responsible for any damages resulting from Client’s failure to uphold its responsibilities under this paragraph. <br />4. Client Pre-Work Responsibilities: Client must make water, electricity, and driveway available for Contractors use during the entire project. <br />Contractor may need access to any room in the home, depending on the locations of water lines, drains, and electrical panels. Client grants <br />Contractor full access to the property during the work. Client agrees to restrain pets, or otherwise keep them out of Contractor’s way. No <br />water may be used inside the property during the work and Client will make arrangements to use bathroom facilities elsewhere. Due to the <br />time sensitive nature of the epoxy used, Contractor’s work must take priority over all other work, projects, and people at the property. <br />5. Warnings: Carpet around the Contractor’s work area may get wet. Carpet near the cleanout area may be stained from epoxy. Painted <br />floors may be damaged and while Contractor will take care to prevent damage, Contractor does not warrant or repair any damage done to <br />painted floors. <br />6. Property Owner: Contractor understands and relies upon Client’s representations that Client is the lawful owner of the property upon <br />which work is being completed or has legal authority to authorize the work on the property. Contractor is not liable for damages, actions, or <br />losses brought or incurred by the Client as a result of work performed by Contractor on property not owned by the Client, or for which the <br />Client did not have legal authority to authorize such work. Nothing in this paragraph will absolve the Client of his/her obligation to <br />Contractor to pay for all work performed by Contractor at the request of the Client. <br />7. Insurance: Contractor will carry workers compensation for all employees performing work under this Agreement. Contractor will carry
