" Zoning File #1017 <br />June 2, 1986 <br />Page 3 of 7 <br />sleeping accomodations are furnished to the public as regular rooms, for <br />periods of one week or more, and provide no morp, than 7 guest rooms to the <br />public". Hennepin County would require a license :or such use and conduct <br />annual inspections of the facility. Prior to the issuance of a building <br />permit by the City, Hennepin County's Environmental Health Specialist must <br />renew and approve all plans for B&B facilities. <br />The State Fire Marshall will inspect the premises to ,ssure that all State <br />Fire Code Standards are upheld. the facility must be approved by the Fire <br />Marshall before it is open to the public. As the B&B will not provide <br />meals, the more restrictive standards for the licensing of the kitchen <br />facilities is not required by the Board of Health or Hennepin County. <br />In 1985 Council directed staff to draft an amendment of the zoning code <br />that would allow B&B use as a conditional use permit rather than as a <br />permitted use requiring a license. The City Attorney advised that <br />licensing would not address the land use concerns of such a use. A <br />conditional use permit can be "as restrictive as the City wants". A <br />conditional use permit can be reviewed at specified times - controls can be <br />best assured as conditions of approving resolutions rather than as a <br />permitted use under licensing. <br />The following issues were compi lF ' by staff from Counci l's directive of <br />1985 for Planning Commission's cons_ierati_on: <br />Performance Standards for Bed & Breakfast Use <br />A) Zoning District <br />1) Are all zones suitable for B&B use <br />2) Are existing controls within each district adequate <br />Ex: hardcover alone would deter a B&B use on an established <br />substandard lot in LR-lC and LR-iB <br />Applicant would have no hardcover problems <br />B) Area - <br />1) Lot must meet all area and width standards <br />2) Lot must meet 150% of lot standards <br />Current application would satisfy either 1 or 2 <br />C) Ownership/Residency - <br />1) Owner occupied <br />2) Full time live in manager <br />Staff recommends owner occupancy/primary residence <br />D) Access - <br />1) Safe access - more intense use require approval <br />or County <br />2) Access cannot be shared with other residential <br />Must have separate/independent access drive <br />Applicant has separate access - should be reviewed <br />by either City <br />by County <br />
