A RESOLUTION ALLOWING <br />ENCROACHMENT OF A BOATHOUSE <br />ONTO A PUBLIC ALLEY <br />4075 HIGHWOOD ROAD <br />WHEREAS, Jan and Nora Ackerberg (hereinafter "the <br />applicant") are the owners of the property located at 4075 Highwood <br />Road with'n the City of Orono (hereinafter "City"); and <br />WHEREAS, existing on the applicant's property is a boat <br />house that is partially on a public alley adajcent to 4075 Highwood <br />Road; and <br />WHEREAS, the boathouse is a non -conforming structure as per <br />Section 10.03, Subdivision 4 of the Orono Municipal Code; and <br />WHEREAS, the Orono City staff has determined that the <br />encroachment of the boat house onto the al ley does not deter public <br />access at this time. <br />NOW, THEREFORE, BE IT RESOLVED that the Orono City Council <br />does hereby authorize the existance of the boat house on the public <br />alley until such time that any of the conditions in Section 10.03, <br />Subdivision 4 of the Orono Municipal Code occur or the Council <br />determines that it is a detriment to its access or right of way. <br />FUTHER, LET IT BE RESOLVED that this permit does not create <br />any property right of the building owner as it relates to the right of <br />way or the City of Orono's right, thereto. <br />Adopted by the O no City Council o:, this 9th day of June, <br />1986. <br />Ayes, Nays <br />ATTEST: <br />",orothy M.
