C) This lot is consistent with the existing development <br />pattern of the neighborhood. <br />D) The findings of fact of Resolution 1E98 are still <br />appropriate. <br />5. There appear to be no other alternative uses of the property. <br />6. The building envelope for this lot with standard setbacks of <br />the LR-lB Zoning District is sufficient to develop a residence <br />and the ordinary driveways and appurtenant improvements while <br />still meeting hardcover requirements. <br />7. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports :I City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />8. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance <br />would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the applicant, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />applicant; and would be in keeping with the spirit and intent of <br />the Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to the Municipal Zoning Code Section 10.24, <br />Subdivision 5 (B) to approve the construction of a residence on a <br />substandard lot of area 17,030 square feet where 43,560 square feet of <br />area is required, and a lot width of 100 feet where a lot width of 14C <br />feet. is required, subject to the following conditions: <br />1. Payment of $225.00 sewer unit charge with the building <br />permit. <br />2. Dedication of the platted portions of County Road 19. <br />3. No setback or hardcover variances will be granted. Maximum <br />hardcover on the lot to be 5,109 square feet or less including <br />buildings, driveways, patios, decks, etc-. <br />Page 2 of. 4 <br />
