Bernhardson, ('-Ly Administrator <br />Jeanne n, Mabusth, Zoning Administrator <br />Date: November 20, 1985 <br />Subject: #991 William 111rich, 1535 Bohn's Point Roar] - <br />Conditional Use Permit <br />This is to advise you that the Planning Commission called for a stop <br />work order for ail building and grading activities at the Ulrich site. <br />They demanded imm �diate action because of the filling and grading viola- <br />tions within the 0--75' setback area and major filling and grading performed <br />by the applicant out of the sco of the original building permit and the <br />original grading p'- <br />The Bohn's neighbors reported that filling has been going on for <br />the past year al _ _..at now they were excavating the wetlands on the Blohorn <br />property. <br />Staff had worked with Ulrich after a straight line winI storm had <br />knocked down over 100 mature ti•-s -on the site and allowed him to do <br />grading and filling where trees were removed and repairs to a drainage <br />system that had been damaged. Ulrich has admitted that he did bring in <br />approximately 4000 cubic yards of fill later that year to prepare the <br />building site. This all appears mute in consideration of the building site <br />now. The huge stock piles of earth cover everything. The neighbors claim <br />the house has been raised above existing grade. <br />The filling within the 0-75' setback area does not involve major <br />changes in elevation but does involve filling of about 3 to 6 inches -op <br />soil for planting of grass. Staff has requested silt fencing along `he <br />entire disturbed area adjacent to the lagoon. It is my understanding Jrom <br />staff that this wall was done sometime around the third week of October. <br />The applicant was advised to file an after -the -fact conditional use permit. <br />The additional filling and grading completed within the original <br />Blohorn property and the Ulrich property is not covered by this land use <br />application and staff will ask that a separate after-*he-f_act application <br />be filed. From reports of the neighbors and building c,:)ntractor's staff on <br />site, this work was completed on November 9th & 10th, week before the <br />November 18th Planting Comm i ;sAC meeting. This involves major filling and <br />grade chang,-s never reviewed with staff. <br />Staff has been advised by the Public Works Department that the re- <br />ported excavation of the wetlands involved the sewer connection and a <br />clean out pipe installed at the edge of the wetlands. The elevation of the <br />basement floor is at 933, the flood plain elevation of 931.5 requires that <br />the floor be at a minimum elevation of 932.5; most City codes woulc ar" for <br />a 933.5 elevation. The f irst f loor or ceiling of the basement is 1... _eet <br />high. The west portion or one third of the foundation will require 2 feet <br />cuts , ) the upper slopes. There is nothing in our code that limits the <br />height of a basement.. The height of a structure is determined per diagram <br />enclosed for ir. review. The house does not exceed 30 feet from prC-)osed <br />finished grade. <br />
