AGRFFMFN'i' <br />AGREEMENT, made and entered into this day of , 198 ; <br />by and between WHITE BEAR ANIMAL CONTROL, INC., hereinafter referred to <br />as "WRAC" and the CITY OF ORONO, a municipal corporation, County of <br />Hennepin, State of Minnesota, hereinafter referred to as "CITY/TOWN". <br />WITNFSSF.TH: That WBAC, in consideration of the covenants and <br />agreements of CITY/TOWN hereinafter contained, hereby covenants with <br />CITY/TOWN that WBAC will provide Animal Control Seā¢lice to CITY/TOWN <br />pursuant to the following provisions: <br />1. That WBAC shall pick up animals found in violation of <br />CITY/TOWN's ordinances in a vehicle appropriate for <br />the transportation of small animals. Patrol service <br />shall be provided in accordance with a schedule <br />mutually agreed upon by the parties hereto. Standby <br />call -out service shall be ;rovided on a twenty-four <br />(24) hour basis at the specific request of CITY/TOWN's <br />law enforcement agency and/or a previously specified <br />official of CITY/TOWN. <br />2. That patrolling shall be performed by competent WBAC <br />personnel trained in the handling of animals. That <br />such personnel shall be subject to approval by <br />CITY/TOWN at CITY/TOWN's leques=. <br />?. That WBAC shall equip, service %nd maintain all <br />vehicles used for Animal Contc Service with two-way <br />radios or other communication. <br />4. Pursuant tc Minnesota Statute 35.71, WEAC shall <br />impound all animals picked up in CITY/TOWN at its <br />Animal. Shelter lo:ated at 506 llth Avenue North, <br />Minneapolis, Minnesota. Said animals shall be <br />confined in a humane manner for a period of not less <br />than five (5) business days or until claimed by an <br />owne". Animals not claimed before the expiration of <br />five (5) business days shall become the property of <br />WBAC. If an animal is not so claimed, WBAC may <br />dispose of said animal in a humane manner, pursuant to <br />Minnesota Statute Section 35.71, Subd. 3. <br />5. That all. impoundment fees shall be returned by WBAC to <br />CITY/TOWN. <br />6. That euthanjsia service provides by WRAC shall be <br />administered by qualified personnel and the disposal <br />of animal carcasses shall be performed as required by <br />Minnesota Statute Section 35.82, Subd. 2 (_'). <br />
