- Gayl.e's Marina has not had a current license for the <br />past four or f i ve years <br />- In no case has a citation been issued to an; of these <br />marinas for operations without a license <br />Additionally it should be noted that to the extent the City would <br />start issuing citations the marinas may take an action for writ <br />of mandamus compelling us to issue the licenses on the basis that <br />we've issued them in the past for nonconforming or noncomplying <br />marinas. Additionally there are problems that relate to the <br />whole Marina Committee structure and perhaps inappropriate <br />process related to land use changes as it related to our zoning <br />ordinance. <br />ISSUES <br />The following represent the major issues that should be addressed <br />in attempting to improve the results from the City's effort —a in <br />this area. <br />- Procedure - Develop a method by which applications are <br />reviewed and licenses issued (if licenses continue to be <br />issued) in a timely manner prior to the commencement of <br />the operation. <br />- Jurisdiction - <br />- Ability to regulate - have the City futher define its <br />areas for regulation together with those areas it <br />desires to regulate and if appropriate adopt by <br />reference other jurisdiction's regulations <br />- Enforcement - In addition to enforcing the City's own <br />policies determine t!ie extent to which it can or does <br />desire to enforce se regulations of other agencies. <br />It should be noted ..hat the enabling legislation of the <br />L.M.C.u. requires it specifically to contract fcr <br />enforcement between L.M.C.D. and the appl icable <br />enforcement agency. <br />- Goals - The following represent goals the City is <br />apparently attempting to achieve. <br />- Limit crowding on the site licensed <br />- Limit spillover into other commercial and./or <br />residential areas. <br />- Promote safe operation both on the land and on the <br />lake. <br />- Address env. ,nmental concorns. <br />ALTERNATIVES <br />The col lowing represent tw-, major directions the City would <br />undertake assuming that it desires to stay in the business of <br />regulating both marinas and commercial use of facilities. <br />1.
