r <br />TO: Mayor and City Council <br />FROM: Mark Bernhardson, City Auminiotrator <br />DATE: October 18, 1985 <br />SUBJECT: Marina and Jc_.nt 'Use Dock Regulation <br />RpnitrTTnN <br />At present marinas and joint use dock faci 1 ities are current ly <br />regulated both by the City of Orono under Ord i nanc:r- 10.4 1 <br />regarding the 13-2 zoning which applies strictly to marinas <br />together with Ordinance 5.42 which apples to commercial and <br />join~ use dock licensing procedures. Joint use docks under our <br />definition apply to any docks used by boats belonging to more <br />than two persons. In addition both of these areas are also <br />regulated by the LaKe Minnetonka Conservation District in <br />selected areas. (As you will recall L.M.C.D. is c-rently <br />looking at requiring a permit for :any dock that has more than two <br />boats at it, if those do not belong to the owner of the <br />property.) Many of the specific subject items are regulated <br />under both to licensing and zoning ordinances in Orono. <br />During the last several years the City has appointed a Marina <br />Committee composd of three members jointly from the Planning <br />Commission and/or Council to review the various marina <br />applications for licenses. These reviews have principally <br />focused on items which because of the concurrent ordinances <br />became land use issues. Many of these land use changes have not <br />subsequently been reviewed by the Planning Commission or <br />appropriate procedures been undergone tc approve such changes. <br />If the Marina Committee was formally established in Ordinance and <br />granted certain powers in this area this may not be a problem, <br />however as it stands the Planning Commission is still required to <br />act on such Land use issues and that appropriate variances and/or <br />conditional. use permits btu issued to permit such. <br />In years past the City attempted to go through its liter, ng <br />process concurrent with/or prior to the issuance of licenses to <br />the marinas by the Lake Minnetonka Conservation District. In <br />1985 because of L.M.C.D. licensing it was decided that Orono <br />would not have its reviews completed unt i 1 of ter L.M.C.D. <br />licensing was done and the-- marinas were operating which resulted <br />in reviews being done in June, July and August with only routine <br />applications finally issued in the September -October time frame. <br />Tc date there ..are three of the licenses which have not been <br />issued because of problems, associated with those properties. <br />RF..SULTS <br />Because of `he problems issociated with this whole procedure the <br />fc:lluwing -oulty have been realize,i: <br />- fhrr-t of the present marinas do not have current <br />i i,,nses for 1985 incl uding North Shore <br />1 <br />
