City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9W - <br />FILE #978 <br />WHEREAS, Michael McEnany (hereinafter "the applicu._') has <br />an interest in the property located adjac-ent to 2499 Kelly Avenue <br />within the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Outlot A, Kelly Cove (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance <br />to Municipal Zoni ng Code Section 10.03.Subdivision 9(A)to permit the <br />construction of a detached garage on Outlot A of the plat of Kelly Cove, <br />on which parcel no principal structure exists. <br />NOW, ;e, RF.FORE RE IT RESOLVED by the City Council of Orono, <br />M;nnesota: <br />F1 ND I NITS <br />1. This application, was reviewed as zoning file #976 <br />2. The property is located in the LR-113 Single Family <br />Lakeshore Residential Zoning District. <br />3. The plat of. Kelly Cove was approved per Resolution 1.611 <br />on April 23, I-.i4. Condition #2 of that resolution stated: <br />"Outlot A, Kelly Cove, may never be used for future <br />residential construction, but shall remain as an open <br />space area -is densit;, credit for existing duplex units <br />or Lrt:,, 1,2,3, i 4, =:.elock 1, Kelly Cove. Residential <br />;locks may never "'x nstructed on the shoreline of <br />Outlot A, Kelly C( <br />The Council f inds that this "open spree" c' ause r _,f ers to the <br />residential unit der.sit.y limitation of four units, but does <br />not preclude the construction of an accessory structure on <br />the site. <br />4.
