Wh re the provisions of this o dinance u2d cause the authorized (�c% use area of two or more sites to o -rlap, or where there is :,y other unusual con- figura.ion of s -)reline or extended lot lines, which causes a conflict betweei the owners of two or more adjacent or nearby sites as the use of the same area of the lake for docks, mooring areas or other structures or for reasonable access thereto, the owner of any of the affected sites may apply to the Board for a variance pursuant to Section 3.04. A variance may be (a) to permit the applicant to locate a dock, mooring area or other structure in a '.ocation different from that permitted by this ordinance or (b) to permit or require the owner of any adjacent or nearby site to do so. Subd. 8. Iocks: Dimension Limits. A dock as defined in Section 3.01, S�bciv Sion 2, may exceed six feet, excluding posts, in either its length or width, but not both; provided, however, that docks which are in existence on June 30, 1982 and which are in compliance with all the provisions of the LMCD Code other than this Section 3.02, Subd. 8 shall be allowed to con- tinue in their present form without expansion or modification until such time as such docks are replaced or until 50% or more of any such doc': is damaged or destroyed.
