A dock or mo ring area located, constructed, installed or <br />maintain!d under t is provision shall not be considered a <br />"multipl! dock or oorir.g area" unless such dock or mooring area <br />is constructed or aintained for the storage of five or more <br />watercra .t. <br />b) A site in existence on February 1970, which has a <br />lake fz:)ntage of 0 feet or more, but less ian 60 feet, may have <br />a dock extendin( up to 60 feet into the 1:Ke. Any such site <br />which 1 as a lake frontage of less than 40 Lee!t may have a dock <br />which extends be and the authorized dock use area to the point <br />necessary to rea:h a water depth of three feet, and no further; <br />provided that no such dock shall be located or extended more than <br />60 feet into the lake. Side setback requirements shall be <br />observed, however, unless a variance is granted by the Board <br />under Section 3.04. <br />c) The authorized doc' •sse area, in the case of sites 50 <br />feet ir, width or less in exit _ence on February 2, 1970, may be <br />expanded to a sile setback limitation of five feet, provided that <br />such setback in io way impairs access -to neighboring docks. <br />d) The lei gth limitations pre,.cribed by this ordinance may <br />be adjusted under the variance provisions of Section 3.04 to <br />allow the constr<<ction and Mai-t Qnance of a dock in the lake to a <br />water depth of three feet at x..e outer end of such dock to pro- <br />vide adequate water depth for navigation and to protect the <br />environmental quI:lity or natural habitat of the water adjacent to <br />the dock. <br />e) A 25-f(lot addition may be allowed at the outer end of a <br />commercial dock for the purpose of fuel sales and related ser- <br />vice, but in no case for the storage of watercraft or rental of <br />dock space. (As Amended, Ord. No. 18, Sec. 3). <br />Subd. 4. _f_ructures Not to Obstruct. No dock, mooring] or <br />other :structure ;hall be so located as to obstruct a navigable <br />channel., or so :s to obstruct reasonable access to any other <br />dock, mooring a ea or similar structure authorized under this <br />chapter. No do.k, mooring area or similar Structure shall be <br />located or designed so that it unnecessarily requires or <br />encourages boats using it to encroach into any other authorized <br />dock use area. A dock, mooring or other structure is "author- <br />ized" if it is aitomatically permitted under this ordinance or if <br />it is a variance permitted under Section 3.04. <br />
