Parcel B is zoned LR-lA, One Family Lakeshore Residential, <br />under the Zoning Code. <br />Because Lakeville has a prospective purchaser for Parcel B (and <br />Parcel A) who wishes to construct a dock on Parcel B, Lakeville now <br />seeks a determination from the City that a dock may be -instructed <br />on Parcel B. <br />Parcel B And The City Easement For Ferndale Road <br />The City right-of-way easement for Ferndale Road e).tends 33 <br />feet from centerline southwesterly over the northeasterl;, 33 feet <br />of Parcel B. See Exhibit D. The distance between the cent- �e <br />of the easement and the shoreline of Lake Minnetonka is app -mately <br />16 feet. See Exhibit D. The distance from the edge of the paved <br />surface of Ferndale Road to the shoreline is 8-1/2 feet.. See <br />Exhibit D. <br />The City Public Works Coordinator has stated that an area <br />10 feet beyond the paved surface of verndale Road is required for <br />maintenance. This area extends approximately 1-1/2 feet beyond the <br />shoreline of Lake Minnetonka along Parcel B. <br />The Attempt To Construct A Dock <br />On April 28, 1984, Mr. H. H. Tearse telephoned Mrs. Jeanne <br />A. Mabusth, City Zoning Administrator, regarding a proposed dock <br />on Parcel B. Ms. Mabusth confirmed her conanents to Mr. Tearse <br />concerning the Jock in a letter on the same day. See Exhibit E <br />attached hereto. <br />Subsequently, ccnstruction o% a dock on Parcel B commenced. <br />On May 23, 1984, Mr. Thomas J. Jacobs, City Building Official, <br />sent a letter to Soarlo Grain Company summarizing the results of <br />
