Family Lakeshore Residential, under the City's Code of Ordinances <br />Chapter 10, Land Use Regulations (Zonincj) (hereinafter "Zonin,� <br />Code"). <br />Because Lakeville had a prospective purchaser 1 <br />A (and Parcel B) who wishes to construct a residence 21 A, <br />Lakeville has applied for and been granted certain var.� for <br />construction of a residence on Parcel A. <br />Parcel B <br />The second parcel is the northerly corner of Lit 9, North <br />Shore Cottage Acres (Hereinafter "Parcel B"). See Exhibit A <br />attached hereto. Lot 9 was originally platted in 1902. Parcel <br />B was separated from the rest of Lot 9 on September a, 1945. See <br />Exhibit B attached hereto. The Ferndale Road right-of-way runs <br />over the northeasterly 33 feet of Parcel B. The remaining unen- <br />cumbered portion of Parcel B measures 25 feet on each of its <br />four sides. <br />When originally platted, the portion of Lot 9 unencumbered <br />by the Ferndale Road easement which later became the unencumbered <br />portion of Parcel B was completely submerged under Lake Minnetonka. <br />See Exhibit C attached hereto showing "Shoal 'water Channel And <br />Dredging Area" over this entire area. When separated frcm Lot 9 <br />in 1945 and ap to and including the present, the portion of Parcel <br />B unencumbered by the Ferndale Road easement has been and remains <br />completely submerged under. Lake Minnetonka.
