the parents of the employee, a child-in-lar, or sibling -in-law, any member of the family members <br />listed of a spouse or registered domestic partner. <br />21.5 Minnesota Paid Family and Medical leave Act. Beginning January 1, 2026, the employer <br />shall contribute the statutory obligation. If the Employee qualifies for both Minnesota Paid Leave <br />and Family and Medical Leave Act (FMLA) program for the leave, they must take both <br />programs concurrently. <br />ARTICLE 22 SEVERANCE PAY <br />22.1 Accumulated sick leave balance. Each employee with at least three (3) years, but less than <br />twelve (12) years, of service with the employer will receive, upon honorable termination of <br />employment, one-third (1/3) of the employee's accumulated sick leave as severance pay. Each <br />employee with twelve (12) years or more of service with the Employer will receive, upon <br />honorable termination, one-half (1/2) of the employee's accumulated sick leave as severance pay. <br />Upon honorable termination, the employee's sick leave balance shall be paid into the Post <br />Employment Health Care Savings Plan as defined in this labor Agreement. <br />22.2 Accumulated Vacation and Comp Time balances. Each employee will have their unused <br />vacation and comp time balances paid out in cash to the employee upon termination of <br />employment. <br />ARTICLE 23 POST EMPLOYMENT HEALTH CARE SAVINGS ACCOUNT <br />Each employee shall participate in the Minnesota Post Employment Health Care Savings Plan <br />(HCSP) established under Minnesota Statutes section 352.98. All funds collected by the <br />employer on behalf of the employees shall be deposited into the HCSP. Commencing January 1, <br />2008, each employee shall contribute 2% of salary to the HCSP. The employer shall deduct this <br />amount from each payroll check. Upon termination of employment 100% of severance pay, as <br />that term is defined in this Labor Agreement, shall be deposited into the HCSP. <br />ARTICLE 24 POST LICENSE <br />The employer agrees to pay the cost of the employee's post license fees. <br />ARTICLE 25 WAIVER <br />25.1 Any and all prior Agreements, resolutions, practices, policies, rules and regulations <br />regarding terms and conditions of employment, to the extent inconsistent with the provisions of this <br />Agreement, are hereby superseded. <br />25.2 The parties mutually acknowledge that during the negotiations which resulted in this <br />Agreement, each had the unlimited right and opportunity to make demands and proposals with <br />respect to any terms or conditions of employment not removed by law from bargaining. All <br />Agreements and understandings arrived at by the parties are set forth in writing in this Agreement <br />for the stipulated duration of this Agreement.
