Zoning Files #852 and #927 <br />August 21, 1985 <br />Page 2 <br />3. City staff tc determine need for fabric liner within excavated <br />pond - mixed views of experts on this issue. <br />4. Final grading and landscaping plans for banks of pond, temporary <br />channel to southern culvert and upland slopes within watershed. <br />As staff advised in an earlier memo, the City has a Conservation & <br />Flowage Easement over the 3/4 acre retention area. The applicant may wish <br />to amend the original easement to more closely reflect the retention area <br />of new pond. If the applicant plans to pump water from main lake to <br />maintain desired water level in pond, the DNR must approve via permit. <br />Staff is not able to report back to you on the wildlife alteration <br />because we await confirmation by the participating experts of the written <br />report drafted by the City Administrator that summarized the findings and <br />recommendations discussed at our August meeting. We expect to report back <br />to the Council at your October 7th meeting. <br />If Council has no problem with the division of the original proposal <br />in granting separate approval for the decorative pond alteration so that <br />the applicants can commence the installation this fall, staff recommends <br />approval of the temporary alteration based on the following findings: <br />1. The construction of the decorative pond as currently proposed will <br />have no detrimen 1 effects on the original or total project. <br />2. The current proposal could be approved as an independent project <br />and its successful operation does not hinge or depend on the <br />alteration of the upper wetland. <br />3. The current proposal as amended by staff and experts will provide <br />increased retention, provide a much needed sediment trap and improve <br />the quality of the water that enters the lake with the aeration of the <br />pond. <br />Direct staff to draft an approving resolution for action at your next <br />meeting. <br />
