Gaffron, Assistant Zoning Admini d, <br />iator <br />1Y OF <br />Date: August 1, 1985 NV <br />Subject: #938 Robert Nash 10 Townline Road - Variance <br />Zoning District - RR-lA, 5-. _ <br />Application - Side setback variance to construct a pole barn <br />for Storage and for use as a stable for horses. <br />List of Exhibits <br />Exhibit A - Application <br />Exhibit B - Plat Map <br />Exhibit C - Property Owners List <br />Exhibit D - Survey <br />Exhibit E - Staff Sketch <br />Exhibit F - Letter From Neighbor <br />The applicant wishes to construct a 301x40' or 301x48' pole barn <br />near his north lot line to be used both for storage of equipment and <br />to stable one or more horses. This would appear to fall under the <br />category of a private stable or barn per Section 10.02.65, and is not <br />restricted to the 1000 square foot area requirement, but "should" <br />maintain a 150' setback from the nearest lot line per 10.02.65, and <br />"shall" be located at least 150' from the nearest off -site residence <br />per 10.03, Subdivision 18(B). The property is 5.8 acres total, of <br />which approximately 5.5 acres is dry buildable. <br />The applicant wishes to construct this barn as near to the north <br />lot line as possible (see sketch). Staff would make the following <br />observations about this property: <br />1. This property and that to the immediate north are 5-acre lots <br />in a 5-acre zone and are not subdividable under current zoning <br />regulations. <br />2. Both this property and that to the north have established <br />residences and both are currently maintaining a limited number of <br />horses, which is an established use for the properties. <br />3. The properties to the east and south are undeveloped and the <br />proposed barn will be located more than 150' from these lot <br />lines. <br />4. The proposed barn will be located 400 feet or more from the <br />residence to the north. <br />5. Applicant has a hardship in that the property width is only <br />223', hence a 150' setback from both side lot lines is <br />impossible. <br />
