City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />10. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to neigh- <br />boring property; would not merely serve as a convenience to <br />the applicant, but is necessary to alleviate a demonstrable <br />hardship or difficulty; is necessary to preserve a sub- <br />stantial property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Cotinci 1 <br />hereby grants a variance to Municipal Zoning Code Section 10.22, <br />Subdivision 2 to permit the construction of a patio, second story <br />screen porch, sidewalks and driveway with backup apron which <br />increase the hardcover in the 75-250' setback zone to 3,572 <br />square feet or 31.7%, subject to the following conditions: <br />1. Per the directive of Resolution 1768, adopted by the <br />Council on May 28, 1985, the concrete patio in the 0-75' <br />setback area shall be removed, by September 1, 1985, except <br />for the corner section comprising approximately 5 square <br />feet in the 0-75' zone (see Exhibit A). <br />2. The asphalt driveway backup apron of 18'xl6' is allowed <br />to remain in place. <br />3. The sidewalk sections and portion of patio in the 75- <br />250' setback zone are allowed to remain in place. <br />4. A 10'x10' second story screen porch with patio directly <br />underneath is allowed at the location shown in Exhibit A. <br />5. The applicant shall remove the plastic underlying the <br />rock beds on the property, and may replace with a permeable <br />fabric or other non -hardcover material;, or shall perforate <br />the plastic so that it meets City staf f's approval as non- <br />h-Ardcover. <br />6.
