City of ORONO <br />RESW ITION OF THE CITY COUNCIL <br />NO. <br />D) The property 'is severely restricted due to the lot <br />size of only 0.4 acre in the 2-acre zoning district, <br />and in that more than 1/3 of the property lies within <br />75 feet of the lakeshor.e. <br />E) It would be appropriate to recommend to the Council <br />that the plastic -underlain rock beds be made non - <br />hardcover by removal or replacement of the plastic; <br />that the driveway backup apron be removed as it is not <br />needed to avoid backing onto a street; end that any <br />additional patio or screen porch on the lake side in <br />the 75-250' zone be traded off with existing hardcover <br />on that side of the house. <br />4. The Council recognizes that it was preferable, from the <br />standpoint of preserving or improving the water quality of <br />Stubbs Bay, to create the Bayside Beach lots in place of <br />allowing continued use of the property as a marina. The <br />Council recognizes that when the City created this lot and <br />the other lots within the Bayside Beach Subdivision, a <br />number of hardships were also created, due to the small lot <br />sizes and the dedication of land for an outlot to serve as <br />access and for the septic system drainfields. <br />5. The City issued a building permit for the property in <br />spite of the fact that the house would take up most of the <br />allowed 75-250' hardcover on the property. <br />6. From a development standpoint, the property is too low <br />for a basement to be feasible, which necessitates a larger <br />structure above ground. <br />7. The driveway backup apron has value from a s,.fety <br />standpoint and should be allowed to remain. <br />8. The sidewalks and proposed 10'x10' patio and screen <br />porch in the 75-250' setback zone provide amenities which <br />add to the livability of the property while contributing <br />only slightly to the hardcover percentage. <br />9. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health, <br />safety and welfaze of the community. <br />Page 2 of 5 <br />
