CQ') � L MEETIN <br />TO: <br />Mayor <br />and City Council <br />JUL 221285 <br />FROM: <br />Mark <br />Bernhardson, City Administrator <br />C1`F l� unn <br />k�o <br />DATE: <br />July <br />19, 1985 <br />SUBJECT: Crystal Bay Road <br />The attached memo from Jeanne Mabusth outlines the hardcover <br />calculations regarding the 3385 property toge.ner with raising <br />selected issues in consideration of that property and others like <br />it. <br />Primary issues at this time being addressed are: <br />a) The extent to which the City of Oron- requires a <br />variance for hardcover particularly hardcover that <br />predated the ordinance when the hardcover survey comes <br />about as a result of a complaint as opposed to either <br />granting a permit or variance for construction. <br />b) The City's treatment of any structures that are <br />built on the railroad right-of-way. <br />Absent Council direction to the contrary staff is taking the <br />following direction regarding these issues: <br />a) HARDCOVER - That staff will require a variancF! <br />request for all hardcover that an applicant desires '.o <br />retain that came about subsequent to the passage of the <br />hardcover ordinances. Staff is treating all hardcover <br />that existed prior to the regulations as nonconforming <br />and when enforcement is to he done on a complaint basis <br />classify it as nonconforming and require a variance only <br />for hardcover added subsequent to that date. Should a <br />variance request he made the total amount of hardcover <br />would be subject to the variance consideration. <br />b) ACCESSORY STRUCTURES - Such structures violate the <br />zoning ordinance as they areaccessory structures on a <br />parcel without a principal structure. For a variance to <br />be requested I am sure it would require permission or in <br />fact an easement from the owner of the property before <br />such a request could be considered or at least granted.) <br />(In this particular situation since the entire right-of- <br />way sits within 75-250 foot setback and any structure or <br />other hardcover on the right-of-way put there by the <br />owners of the abutting residential property should be on <br />their property and would be counted against the area <br />solely for the property owned by that individual.) <br />
