MINUTES OF THE ORONO PLANNING COMMISSION MEETING HELD JUNE 17, 1985. PAGE 10 <br />#927 GREGORY Zoning Administrator Mabusth stated that staff does not <br />(Cont.) consider a pool hardcover but does consider it a structure <br />which would be located within the 0-75' setback area in this <br />case. Mabusth noted that it is the proposed concrete patios <br />around the pool that is considered hardcover. <br />Kelley asked if the applicants planned to construct a <br />swim j pool before the home was built. <br />Stanley Gregory stated yes they had planned on constructing a <br />pool. <br />Chairman Callahan stated that the overal:. plan should have <br />been submitted at the time the permit was applied for. <br />Callaha- stated that the City should have be notified of the <br />applicai s future plans for the 1ct. <br />Goetten asked the applicant if there are any more future <br />plans for the property other than the pool and greenhouse. <br />Stanley Gregory stated that they have no other plans. <br />Gregory noted that the greenhouse's proposed location was <br />located there so the house could face the southeast side to <br />catch the sun. Gregory stated that the topography of the <br />land is such that the home had to be placed in its present <br />location which places hardships on location of other <br />structures. Gregory asked if duck board around the pool <br />would be considered hardcover. <br />Sime stated that even if the pool was moved back away from the <br />shoreline, that 90% of the pool would still be located in the <br />0-75' setback. <br />Rovegno noted that it is a lovely piece of property and that <br />the pool would compliment the site nicely. <br />Kelley felt that he could approve the pool. Kelley noted <br />that he felt that the City was taken advantage of by the <br />applicant by not revealing the applicant's future plans. <br />Kelley felt that the whole development had poor planning and <br />that the City was given poor representation in the future <br />plans for development of the property. <br />McDonald noted the applicant's hardships in the steep <br />topography of the land, the location of caretaker's house, <br />and the current septic location. <br />Chairman Callahan closed the public hearing at 9:45 p.m. <br />Sime moved, Chairman Callahan seconded, to deny the variance <br />application of Stanley Gregory based on the following <br />findings: <br />1. Early planning decision made by applicant or authorized <br />agents of applicant created the need for the variance. <br />
