City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION DENYING VARIANCES REQUESTED <br />BY AI.DEN ANDERSON FOR A PROPERTY LEGALLY <br />DESCRIBED AS TRACTS C AND D, REGISTERED <br />LAND SURVEY 96 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq. <br />the City Council has adopted zoning regulations for the :-otection of the <br />public health, safety and general welfare; and <br />WHEREAS, Alden Anderson has applied for a lot width and lot <br />area variance to per:,iit construction of a new sinc;le family residence <br />on a property legally described as Tract C and Tract D, Registered <br />Land Survey 96, hereinafter referred to as the property; and <br />WHEREAS, the City Council has reviewed the application; the <br />recorrmendations of staff and the Planning Commission; cor^mentE of the <br />neighboring property owners; and letters and cormme nts male by the <br />applicant. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of. the <br />City of Orono hereby denies the requested lot width and lot area variances <br />(Section. 34.352) for Tracts C and D R.L.S. 96, and denies other required <br />variances, which variances are lot area variance (Section 34.352) Tracts <br />E & F, R.L.S. 95 and development of substandard lots of record 'held <br />in common ownership (Section 31.202) for Tract C, D, E and F, R.L.S. 96, <br />based upon one or more of the following findings of fact con:ern4:,g <br />this property: <br />1) The property is located in the Lf?-lA Single Family Lakeshore <br />Residential District which has the following minimum lot <br />requirements: <br />Section 34.352 <br />Lot Area = 2 acres <br />Lot Width = 200 ft. <br />Front setback = 50 ft.. <br />Lake setback = 75 ft. <br />Side setback = 30 ft. <br />2) Tract C, the proposed building lot is deficient in regards to <br />lot area and lot width requirements as follows: <br />Tract C's area exclusive of road easement per Section <br />31.204 is 1.7 acres - short 13,068 sf or 151 <br />Tract C's actual width is 120.3 tt. - shoe_` 79.7 ft <br />or 40% <br />
