RESOLUTION FOR INDEMNICATION OF ORONO POLICE OFFICER <br />KCURT ERICKSON <br />WHEREAS, the City of Orono and its Police Officer Kurt <br />Erickson have been named as defendents in a suit arising out of <br />an accident that occurred on November 20, 1984, involving the son <br />of the plaintiffs, Craig L. Quiggle; and <br />WHEREAS, the suit requests in addition to in excess of <br />$50,000 actual damages requests punitive damages against the <br />individual officer; and <br />WHEREAS, the insurance policy between the City and its <br />insurer covering both the City and the individual specifically <br />excludes payment for punitive damages; and <br />WHEREAS, the City of Orono has the authority under <br />Minnesota Statute _ _ to indemnify police <br />officer upon his request; and <br />WHEREAS, the facts as known by the City and its legal <br />council at this time do not provide any basis for punitive <br />damages. <br />NOW, THEREFORE BE IT RESOLVED, by the City Council, the <br />City of Orono hereby indemnfies its Police Officer Kurt Erickson <br />for any punitive damages arising out of the subject case based on <br />the facts as presently known and only to the extent such damages <br />are not covered by insurance. <br />Adopted by the City Council of the City of Orono, <br />Minnesota at a regular meeting held May 28, 1985. <br />Mary C.
