13.2 REMEDIES <br />The duties and obligations imposed by these GQneral Conditions and the rights <br />and remedie avai?able hereunder to the parties hereto, and, in particular but <br />without limitation, the warranties, guarantees and obligations imposed upon <br />Contractor herein and all )f the rights and remedies available to Owner and <br />Engineer thereunder, shall be in addition to, and shall not be construed in <br />any way as a limitation of, any rights and remedies available to any or all of <br />them which are otherwise imposed or available by law or contract, by special <br />warranty or guarantee or by other provisions of the Contract Documents, and <br />the provisions of this paragraph shall be as effective as if repeated specif- <br />ically in the Contract Documents in connection with each particular duty, ob- <br />ligation, right and remedy to which they apply. All representations, warran- <br />ties and guarantees made in the Contract Documents shall survive final payment <br />and termination or completion of. this Agreement. <br />13.3 PUBLIC CONVENIENCE <br />The Contractor shall at all times so conduct his work as to insure the least <br />possible obstruction to traffic and inconvenience to the general public and <br />the residents in the vicinity of the Work, and to insure the protection of <br />persons and property. No road or street shall be closed to the public except <br />with the permission of the Owner and proper governmental authority. Fire <br />hydrants on or adjacent to the Work shall be kept accessible to fire -fighting <br />equipment at all times. Temporary provisions shall be made by the Contractor <br />to insure the use of sidewalks and the proper functioning of all gutters, <br />sewer inlets, drainage ditches and irrigation ditches, which shall not be <br />obstructed. <br />13.4 CROSSING UTILITIES, ETC. <br />Where the prosecution of the Work results in the crossing of highways, rail- <br />roads, streets or utilities under the jurisdiction of bt-ate, county, city or <br />other public or private entities, the Contractor shall secure written permis- <br />sion from the proper authority to cross said highway, railroad, street or <br />utility before further prosecuting the Work. A copy o' the written document <br />granting permission shall be filed with the Owner and Er,,ineer before any Work <br />is done. The Contractor shall be required to obtain .a written release from <br />the applicable authority upon completion of the Work. A copy of this written <br />release shall be filed with the Owner and Engineer before final acceptance of <br />the Work is granted. <br />13.5 SANItARY PROVISIONS <br />The Contractor shall provide and maintain such sanitary facilities for the use <br />of his employees and those of his Subcontractors as may he necessary to comply <br />with the laws, rules or regulations of the Federal, i,.ate and local gave ra- <br />ments, or agencies or departments thereof. <br />- 148 <br />1,'M5 - 8507h <br />Copyright 1985 <br />Bonestron, RoKene, Arvior l ik <br />6 Associates, Inc. <br />
