FM <br />11.4 CHANGE OF CONTRACT TIME. <br />11.4.1 The Contract Timi may only be changed by a Change Order. Any <br />claim for an extension in the Contract Time shall be based on written <br />notice delivered to Owner and Engineer within ten (10) days of the occur- <br />rence of the event giving rise to the claim. Notice of the extent of the <br />iJ <br />claim with supporting data shall be delivered within thirty (30) days of <br />such occurrence unless F.ngineei allows an additional period of time to <br />ascertain more accurate data. All claims for adjustment in the Contract <br />W <br />Time shall be determined by Engineer if Owner and Contractor cannot other- <br />wise agree. Any change in the Contract Time resulting from any such claim <br />shall be incorporated in a Change Order. <br />11.4.2 The Contract Time will be extended in an amount equal to time lost <br />due to delays beyond the control of Contractor if a claim is made therefor <br />as provided in paragraph 11.4.1. Such delays shall include, but not be <br />limited to, acts or neglect by Owner, or to fires, floods, labor disputes, <br />1 <br />epidemics, abnormal weather conditions, or acts of God. <br />p 11.4.3 All time limits stated in the Contract Documents are of the <br />essence of the Agreement. The provisions of this paragraph 11.4 shall not <br />exclude recovery for damages (including compensation for Additional <br />professional services) for delay by either party. <br />SECTION 12 <br />SUSPENSION OF WORK AND TERMINATION <br />12.1 OWNER MAY SUSPEND WORK <br />It Owner may, at any time and without cause, suspend the Work or any portion <br />thereof for a period of not more than ninety days by notice in writing to Con- <br />tractor and Engineer which shall fix the date on which Work shall be resumed. <br />Contractor shall resume the Work on the date so fixed.
