Mabusth, Building & Zoning Administrator <br />DATE: June 20, 1985 <br />SUBJECT: Status report regarding alleged violations on properties <br />located at 3385 and 3393 Crystal Bay Road <br />Point A in Jerry Wheeler's letter: <br />"A) Both Mr. Carl and Mr. Johnson placed hardcover between their homes <br />in 1983, where there was non before. I believe this hardcover <br />consists of gravel underlined with solid sheets of plastic (without <br />holes) and directly feeds all water and runoff from between their homes <br />and much of their roofs onto an asphalt driveway and directly into the <br />lake without any absorbtion opportunity what -so -ever. This covers <br />the entire land area; N, S, E, and W; between their homes. Let's face <br />it, other Orono Citizens must build 'water holding tanks/basins'????" <br />Staffs comments regarding Point A: <br />A) Regarding claim that h-dcover has been placed between the two <br />residences in the form of gravel underlined with plastic sheeting. <br />An inspection conducted by both Tom Jacobs and myself on June 17, 1985, <br />revealed that course crushed red rock had indeed been placed as <br />reported. Staff found no plastic underliner. Dick Carl had advised <br />that previously they had placed gravel to control drainage but he <br />advised it was a case of overkill. They have since removed both tile <br />and plastic underliner--staff can confirm. <br />In light of previous reviews i5hed red rock (1/2 each to 1 1/2 inches <br />in size) placed on natural gro,,ad where cars do not drive or park but is <br />used for landscaping where it is difficult to maintain ground cover has <br />not been considered hardcover. What is Council's opinion? <br />Point B in Jerry Wheeler's letter: <br />"B) Both Mr. Carl and Mr. Johnson have storage sheds permanently <br />erected within the ten foot setback from a neighboring lot line. <br />These should be addressed." <br />Staff's comments regarding Point B: <br />B) The wood structure/shed at 3385, located ' ss than 10 feet from si, <br />lot line, is not permanent (measures 8' x 12, or a total of 96 sf ) wou. <br />not requirea permit per Uniforn. Ruilding Code (UBC). A permit was not <br />taken out. The 96 sf wa. Ir'. be considered hardcover within the 75-250' <br />setback area. <br />
