Gaffron, Assistant Zoning Administrator <br />Date: May 13, 1985 <br />Subject: #917 Tipton Corporation, 1290 Lyman Avenue - Lot Area <br />Variance <br />Zoning District - RR-lB 2-Acre Unsewered <br />Lot Area Required: 87,120 square feet or 2 acres <br />Lot Area Existing: 49,260 square feet or 1.13 acres <br />Variance: 37,860 Square feet or 0.87 acres (43.5%) <br />I <br />Exhibits <br />Exhibit A - Application <br />Exhibit B - Plat Map <br />Exhibit C - Property Owners List <br />Exhibit D - Survey with Septic Design <br />This property contains an existing house and detached garage <br />both <br />of which are proposed to be removed and replaced with a larger <br />home <br />and attached garage. Lot area is 1.13 acres. <br />Since the existing house will be totally removed, a lot <br />area <br />variance to Section 10.03, Subdivision 6 (A) 3 is required. <br />The <br />criteria for approval of this variance should be: <br />a) proposal meets all other performance standards for the RR-1B <br />district except for lot area; and <br />b) adequate area is shown for primary and alternate drainfield <br />sites. <br />The proposed house does appear to meet the required front, rear, <br />and side setbacks. However, I am quite concerned that the primary <br />drainfield as debigned does not meet minimum setbacks from the house, <br />and the alternate site is not realistically capable of containing the <br />1200 square foot drainfield required while maintaining safe setbacks <br />from the foundation wa11s. It is possible that the systems can be <br />redesigned so that both primary and alternate sites will meet all code <br />requirements. <br />No adjacent land is readily available for purchase without goinq <br />through a subdivision/lot line rearrangement. The applicant has <br />approached the neighboring property owner to the north regarding a <br />possible acquisition of some land; perhaps applicAnt can enlighten us <br />on the status of this. Staff would strongly recommend that applicant <br />acquire additional property to the north or east if possible, which <br />might free up additional suitable area for septic systems. <br />Because this lot has an existing house, and the property owner <br />has a sutitantial property right, we would recommend approval subject <br />to staff approval of the redesiqned drainfield sites, with a strong <br />recommendation that applicant attempt to acquire additional land to <br />make this a more conforming lot. <br />
