Mr. John Gerhardson <br />June 5, 1985 <br />Page 2. <br />South along said West line of Lot 5, Block 3 to a point <br />of beginning. Subject to the rights of the public <br />in that part of the above -described property taken for <br />County Road No. 19/ <br />The above legal is shown because of the possibility of verlap <br />with the Dittrich property. At Entry 102 in the absl-ri_t, <br />Henry W. Jackson deeded a part of the Westerly part of the <br />Dittrich property to the City of Orono and at. Entry 103 in <br />the abstract, Dittrich also quit claimed that same parcel <br />to the City of Orono. That is described as follows: <br />That part of Lot 5, Block 3, Townsite of Langdon Park, <br />Hennepin County, Minnesota, described as follows: Be- <br />ginning at a point on the West line of said Lot 5, dis- <br />tant 182.7 feet North of the Southwest corner thereof; <br />thence North along the West line of Lot 5, distance 93.2 <br />feet; thence North 74 degrees, 30 minutes East, a dis- <br />tance of 50 feet; thence South 66 degrees, 00 minutes <br />West, a distance of 32.61 feet; thence South 21 degrees, <br />31 minutes East, a distance of 85.37 feet, more or less <br />to the intersection with a line bearing North 74 degrees, <br />24 minutes East from the point of beginning; thence <br />South 74 degrees, 24 minutes West, a distance of 51.60 <br />feet more or less to the point of beginning. <br />It is obvious that we cannot include in our torrensing of Dittrich's <br />property the property that has already been conveyed to the City <br />unless the City, for convenience purpose, wants to quit claim <br />the entire interest in Dittrich's property back to Dittrich. We <br />could then complete a torrensing of the whole piece of property <br />and, upon the completion of the torrensing, quit claim the property <br />that the City owns back to the City. That way both the City and <br />Dittrich would end up with torrens title and for their respective <br />parcels. It would be the simplest way of handling the matter. If <br />the City elected to follow that means, they could quit claim back <br />to Dittrich any interest in the entire piece of his land and <br />concurrent with that, Dittrich could deed back to the City the Dart <br />the City now owns with those legals approved by the Examiner of <br />Titles. That later deed would not be filed until the torrensing <br />is completed, however. <br />The underlying title to the property you already own may not be of <br />consequence to you and if that is the case, we will proceed with the <br />torrensing with the remained of Dittrich's property. After Dittrich <br />has completed his torrensing, we can negotiate for the transfer of <br />the additional ladn not previously deeded from Dittrich to the <br />City as outlined in your previous correspondence. <br />
