Council has in the past approved the use of a house trailer <br />via a residents written request for periods of 3 months - - and <br />has extended that time by a motion to approve. <br />1) Do you wish to review request as a variance application? <br />2) Do you wish an ordinance amendment? <br />F. Tree ..emoval within 75 feet of the lakeshore <br />Ordinance requires a permit from Council to remove a tree over six <br />inches in diameter within 75 feet of lakeshore. Code does not distinguish <br />betweer dead or live trees being removed within the setback area. If <br />Council desires to delegate to staff, staff would rec.,.:-,t- nd adoption of a <br />replacement policy as follows: <br />1. If City is asked to approve the removal of a tree, City woul%- ask <br />for one replacement tree planting as a condition. <br />2. If City is asked to approve after -the -fact removal of trees, City <br />would ate' foi two replacement tree plantings for one removed. <br />Sectio. 2, Subdivision 3 refers to a permit from Council. There <br />is no such re. In the past we have reviewed such requests as <br />variances. b review of the wording of the ordinance this may have <br />been an incc rr i ocedure. <br />Alternatives <br />a) Staff to grant all permits* (need for City Attorney opinion <br />regarding delegation of permit authority). Staff will review all <br />requests and approve all permits - City Council may wish update report <br />on all tree removal permits. <br />b) Council to grant all permits* (similar to license reviews). Staff <br />makes inspectj,-!is and makes recommendation to Council. <br />*Permit would be a aneral permit - the permit must be occupanied :y <br />an appropriate fee to cover staff inspections, clerical time and <br />report writing. <br />Staff inspection $25.00 Reinspection additional $15.00 <br />Clerical 5.00 <br />Staff report 10.00 <br />$40.00 <br />
