DRAFT ONLY <br />A RESOLUTION DETERMINING THAT <br />2 SANITARY SEWER SERVICES <br />WILL BE PROVIDED TO <br />THE PROPERTY AT <br />1950 SHORELINE DRIVE <br />WHEREAS, the City of Orono is a Municipal Corporation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />WHEREAS, Sewer Project 85-1 was initiated by the City <br />to solve existing on -site sewage treatment problems in the <br />Crystal Bay area, within which 1950 Shoreline Drive is located; <br />and <br />WHEREAS, 1950 Shoreline Drive consists of a parcel in <br />single separate ownership known as P.I.D. 10-117-23 42 0012, <br />legally 6escribed as: <br />Locs 22 and 23, Ora Park on Lake Minnetonka, and that part <br />o: Lake Street lying between the extensions of the side <br />lines of said lots and between the front line of said lots <br />and the Northwesterly line of the right-of-way of County <br />Road No. 7 (County Road 15); (hereinafter "the property"); <br />and <br />WHEREAS, the property is zoned LR-lA, Single Family <br />Lakeshore Residential 2-acre unsewered; and <br />WHEREAS, the property contains a structrre currently <br />�jsed as a duplex, and contains 2 cabins which-urrently are <br />rented out, for a total of 4 existing dwelling uses on the pro- <br />perty; and <br />WHEREAS, the property contains approximately 14,000 <br />square feet in area or approximately 0.32 acres; and <br />WHEREAS, the 4 dwelling use of the property is con- <br />sidered a non -conforming use, which use has continued without <br />interruption since prior to January 1, 1975; and <br />WHEREAS, Municipal Zoning Cude Section 10.20, <br />Subdivision 3 (1) states as follows: <br />"I. Duplex Credit. One duplex may be located on a single <br />lot as a conditional use upon application therefor provided <br />that public sanitary sewer service is available, and the lot <br />is constructed within 200 feet of the commercial or <br />industrial district.
