City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />4. The small lot size and location of existing house and <br />driveway are hardships to the property. <br />5. The City Council has considered this application <br />including the findings and recommendations of the Planninc, <br />Commission, reports by City staff, comments by the appli- <br />cant, and the effect of the proposed variance on the health, <br />safety, and welfare of the community. <br />6. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to neigh- <br />boring property; would not merely serve as a convenience to <br />the applicant, but is necessary to alleviate a demonstrable <br />hardship cr difficulty; is necessary to preserve a sub- <br />stantial property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon the above findings, the Orono City Council <br />hereby grants a variance to Municipal Code Section 10.55, Sub- <br />division 8, and Section 10.22, Subdivision 1 and 2 to permit <br />removal of the attached garage and construction of additional <br />living area, a screen porch, and deck located within 63 feet of <br />the lakeshore and which will encroach 8' into the average lake - <br />shore setback and which will increase the hardcover in the 0-75' <br />lakeshore setback zone from 3.2% to 5.0% and in the 75-250' zone <br />from 53.8% to 56.8%, subject to the following conditions: <br />1. Hardcover is limited in the 0-75' setback zone to 5.0% <br />and in the 75-250' setback zone to 56.8%, with lakeshore <br />setback of 63' or a variance of 12'. <br />2. Applicant must remove shed and walkway to make tradeoffs <br />in hardcover. <br />3. Railing required on deck. <br />4. Applicant is placed on notice that any future variances <br />for hardcover may not be approved and that owner and future <br />owner are placed on notice that the property is without a <br />garage and such variance application for a garage may nct be <br />approved. <br />Page 2 of 4 <br />
