City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />GRANTING A VARIANCE TO <br />M`JNICIPAL ZONING CODE <br />SECTION 10.55, SUBDIVISION 8 AND <br />SECTION 10.22, SUBDIVISION 1 and 2 <br />FILE 1920 <br />WHEREAS, Lou Fegers (hereinafter "the applicant") is <br />owner of the property located at 3590 North Shore Drive within <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Lot 8, Block 2, Ba ldur Park, lying North of County Highway <br />No. 51 (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City for <br />variances to Municipal Zoning Code Section 10.55, Subdivision 8 <br />and Section 10.22, Subdivision 1 and 2 to permit the removal of <br />an attached garage and replace with addition and living space, <br />screen porch and deck located within 63 feet of the lakeshore and <br />which will encroach 8' into the -,-rage lakeshore setback and <br />which will increase hardcover in 0-75' lakeshore setback zone <br />from 3.2% to 5.0% and in the 75-250' zone from 53.8% to 56.8%. <br />NOW, THEREFORE. BE IT RF.SOLVF.D by the City Council of <br />the City of Orono, Minnesota: <br />FINDINGS <br />I. This application was reviewed as Zoning File No. 920. <br />2. This property is located within the LR-lC Zoning <br />District. <br />3. The Orono Planning Commission reviewed this application <br />on May 20, 1985 and recommended approval based on the <br />following findings: <br />a) The existing garage is becoming separated from the <br />house due to a poor foundation and is in a hazardous <br />and unsightly condition. <br />b) The proposed hardcover tradeoffs by removing a <br />shed, wooden walkway, stoop, and planter decrease the <br />impact of the added hardcover. <br />Page 1 of 4 <br />
