City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 <br />FILE NO. 919 <br />WHEREAS, Theodore M. Schultze (hereinafter "the <br />applicant") has an interest in the property located at 1185 <br />Wyndmere Road within the City of Orono (hereafter "City") and <br />legally described as Lot 3, Block 1, Wyndmere (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City for a <br />Conditional Use Permit to permit the installation of a decorative <br />pond per Municipal Zoning Code Section 10.03, Subdivision 19. <br />NOW, THEREFORE, BE IT RESOLVED by the City Counr7i 1 of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File No. 919. <br />2. The property is heated in thc, RR-lR Rural Residential <br />Zoning District. <br />3. On May 20, 1985, the Orono Planning Commission reviewed <br />the application as proposed and recommended approval, based <br />on the following findings: <br />a) The pond excavation is not located within a <br />designated wetlands. <br />b) The pond will not change the general direction of <br />the flow of the localized watershed. <br />3. The pond will decrease the velocity of the run-off <br />to the west created by the improvements within the <br />Wyndmere plat. <br />4. The City Council has considered this application in- <br />cluding the findings and recommendations of the Planning <br />Commission, reports by staff and comments of the applicant <br />and the effect of the proposed use on the health, safety and <br />welfare of the community. <br />Page 1 of 4 <br />
