0 <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />IMPROVEMENT AGREEMENT <br />FOR THE PLAT OF ORONO OAKS <br />t <br />THIS AGREEMENT, Made and entered into this r// — <br />day of 1)e C e m)r , 19_Z ', by and between the City of Orono, <br />a municipal corporation organized under the laws of the State of <br />Minnesota (hereinafter called "City"), and Richard Neslund (Colpepper <br />Land Company) and Ralph Carlson Companies, Inc. its heirs, successors <br />and assigns, (hereinafter called "Subdivider"). <br />W I T N E S S E T H: <br />WHEREAS, the Subdivider has made application to the City <br />Council for approval of a final plat of land within the corporate <br />limits of the City legally described as Orono Oaks; and <br />WHEREAS, the City Council by Resolution 957 has granted <br />final approval to the Subdivision, on the condition that the Subdivider <br />enter into this agreement to provide for the Improvements hereinafter <br />described on the terms and conditions hereinafter -set forth. <br />NOW, THEREFORE, in consideration of the premises -and of the <br />mutual promises and conditions hereinafter contained, it is hereby <br />agreed as follows: <br />I. PREAMBLE <br />1. Creation of Intersection As an integral part of the <br />Orono Oaks Subdivision, the Subdivider located and created a new private <br />road, legally described as Outlot A, Orono Oaks. The location of this <br />private road was chosen by the Subdivider as beneficial to the arrangement <br />of lots in the subdivision. The intersection of the private road with <br />the public road (Orono Orchard Road) occurs at a location just below the <br />crest of a steep hill in the public road which condition is hazardous <br />with substandard sight and stopping distances according to the Minnesota <br />Department of Transportation Standards. Correction of this condition <br />for conformance with safe intersection standards requires either <br />relocation of the intersection or lowering of the hill on the public <br />road. <br />
