RESOLUTION NO. 942 <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT <br />FOR LOWELL ZITZLOFF <br />WHEREAS, the City of Orono is a municipal. corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />zoning regulations for the orderly, economic and safe development of <br />land within the City; and <br />WHEREAS, the Planning Commission and City Council have <br />considered an application for a Conditional Use Permit by Lowell <br />Zitzloff for use of property and a'building located at 3502 Shoreline <br />Drive in a B-5 Limited Neighborhood Business Use District; and <br />WHEREAS, the applicant's_ stated intention is to operate a <br />retail/wholesale auto parts store on the premises; and <br />WHEREAS, auto parts sales is not a listed permitted or <br />conditional use in the B-5 Zoning ,Use District; and <br />WHEREAS, the review of this application by the Planning <br />Commission and the City Council was pursuant to the intents and <br />purposes of Orono Zoning Code Secion 32.210 requiring a Zoning <br />Occupancy Certificate for all new uses of land or buildings; Sections <br />35.401, 35.402 and 35.420 -establishing the purposes of the B-5 Zoning <br />Use District and Sections 32.410, 32.460 and 32.480 establishing <br />procedures and objectives of Conditional Use Permit reviews; and <br />WHEREAS, after review of the facts and pursuant to the <br />representations of the applicant, the City Council finds that the <br />proposed use is a limited traffic generating business which will <br />serve the neighborhood community and as such is a use consistent <br />with the purpose of the B-5 Zoning Use District, <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of <br />the City of Orono hereby approves a Conditional Use Permit for <br />Lowell Zitzloff subject.to the following conditions: <br />1. All sales and storage functions will be performed <br />within the existing building, except for parking of <br />employee vehicles and business vehicles occurring to <br />• the rear of the building. <br />
