City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION Dr TYING VARIANCES REQUESTED <br />BY ALDEN ANDERSON FOR A PROPERTY LEGALLY <br />DESCRIBED AS TRACTS C AND D, REGISTERED <br />LAND SURVEY 96 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing un.ler the laws of the State of !`Minnesota; and <br />WHER'.AS, pursuant to State Statutes 412 et. seq.. and 462 et. seq. <br />the City Council has adopted zoning regulations for the protection of the <br />public health, safety and general welfare; and <br />WIEREAS, Alder, Anderson has applied for a lot width and lot <br />area variance to per.iit construction of a new single fanily residence <br />on a property legally described as Tract C and Tract 0, Registered <br />Land Survey 96, hereinater referred to as the property; and <br />W.'iEREAS, t1;e City Council has reviewed the application; the <br />recommendations of staff and the Planning Commission; cor--meats of the <br />neighboring property owners; and letters and conbmants made by the <br />applicant. <br />NOW, THEREFORE, BE IT 1%ESOLVED, that the City Co�incil of the <br />City of Orono hereby denies the requested lot width and lot area variances <br />(Section 34.32) for Tracts C and D R.L.S. 96, and denies other required <br />variances, which variances are lot area variance (Section 34.352) Tracts <br />E & F, R.L.S. 96 and development of substandard lots of record held <br />in common ownership (Section 31.202) for Tract C, D, E and F, R.L.S. 96, <br />based upon one or more of the following findings of fact can,-erning <br />this property: <br />1) The property is located in the LR-lA Single Family Lakeshore <br />Residential District which has the following minimum lot <br />reruiren.ents: <br />Section 34.352 <br />Lot Area = 2 acres <br />Lot Width = 200 ft. <br />Front setback = 50 ft.. <br />Lake setback _ 75 ft. <br />Sipe setback = 30 ft. <br />2) Tract C, the proposed building lot is deficient in rec3ards to <br />lot area and lot width requirements as follows: <br />Tract C's area exclusive of road easement her Section <br />31.204 is 1.7 acres - short 13,068 st or 151 <br />Tract C' s actual width i s. 1 20. 3 f t . - short- 79.7 ft <br />or 402 <br />
