I am sending <br />copies of the pertinent code sections dealing with existing lots of <br />record. <br />In regards to the Stubbs Bay Marina property division you <br />referred to, this was previously zoned B-2 commercial and the 3 lot <br />subdivision was arrived at only after intensive study and deliberation <br />by the City. In a nutshell, the 3 residential lots of about 1/2 acre <br />each were found to create a much less intensive use of the lake than <br />the Marina. This would appear to be a unique situation and not really <br />related to your application. <br />As I see it you have two options if you wish to proceed with your <br />proposal: <br />a) Go ahead with the application for a variance of lot area and <br />lot width; application fee $200.00 olus $40.00 refundable land <br />use application sign deposit. <br />or <br />b) File a zoning appeal, i.e. an appeal of the Zoning Adminis- <br />trate interpretation of the zoning code; application fee $100.00. <br />It would be your responsibility to explain to the Planning <br />Commission why the code should not apply in your situation. <br />The deadline for information to be submitted for the April 15 <br />Planning Commission meeting is March 21st.
