A. Fence <br />The applicant wishes to construct an 8' privacy fence along <br />the south line of his property abutting Fastl . Street. There <br />is a 3' berm with pine trees existing at this time. It is not <br />clear from the application whether the fence will be placed on <br />top of or alongside the berm. The berm was constructed when the <br />new houses were built and is above the natural grade of the <br />surrounding area. <br />By existing codes, applicant would be allowed a maximum F' <br />fence along the property line in the side and rear (east) yards <br />and a 2 1/2' fence in the front (lake) yards extending to the <br />lake. Eastlake Street can not be considered a "major thorough- <br />fare" hence a continuous 6' fence would not be allowed along it <br />on that basis. <br />I believe you are familiar with the existing code sections <br />dealing with fences and can relate this application to the fence <br />along Bayside Road just to t'e east. You could also expect, I am <br />sure, opposition to granting of a variance by the property owners <br />along Eastlake Street who would lose a partial view of the lake. <br />Area properi-.y owners did attend the Planninq Commission meetings <br />where this item was on the agenda. <br />In order to approve, you would have to find a hardship <br />exists and show no adverse effect on the purpose and intent of <br />the Zoning Code nor the health and welfare of the public. <br />B. Patios at 3424 and 3444 Eastlake Street <br />During inspection of the septic system at the newly <br />constructed house at 3464 Eastlake Street staff noted that con- <br />crete patios had been constructed at 3424 and 3444. The appli- <br />cant was notified to remove 'hem as non -allowed hardcover, and he <br />opted to apply for an afte_ the -fact variance as an amendment to <br />the fence application. <br />The concrete patio and sidewalks within the 75' lakeshore <br />seti)ack at 3424 Eastlake Street, constitute 216 square feet or <br />3.3% hardcover where none is a 1 Z • .-r ?. The concrete patio and <br />sidewalks at 3444 Fastlake Stree- :onstitute 495 square feet or <br />8.0% hardcover where none is allowed. Again. in order to approve <br />these you must find a hardship, and show no adverse effects on <br />the intent and purpose of the code nor on the health and welfare <br />of the public <br />The Applicant was told by staff that there is little chance <br />fo: approval of varianti-vs for either the fence or the patios, and <br />it was applicants wish to proceed with the applications regard- <br />less. <br />2 <br />
