drive that intersected Johnson's front yard. I don't know the date of <br />the pictures but the gravelled area was already installed. Johnson <br />ad%ised that when he placed the gravel on the subject area that he did <br />not place plastic sheeting underneath but that he placed it over <br />existing ground cover. Staff advised the Planning Commission of the <br />recent findings made by Council in the Johnson application on <br />Fagerness Point where gravel placed on existing grade or over <br />perforated plactic sheeting for landscape purposes was not considered <br />hardcover. Planning Commission could not make the same findings in <br />this case because the gravel placement in the final analysis was used <br />for the parking of a boat and a vehicle - similar to graveling of <br />drives. The gravel interacting with the natural clay rase from pres- <br />sil-e of parked vehicles creates hardcover. <br />2. Construction of Retaining wall <br />Portions of the retaining wall are located within 75' of the <br />lakeshore - as noted above an 8 -o 10 feet strip 6 inches wide extends <br />lakeward up to approximately 6.,' from the lake. That sectioi of the <br />structure now covered with snow but from memory did not appear to be <br />structurally relevant to major retaining wall that suppcits the <br />earthern bank on west side of mouse. I have enclosed a site inspec- <br />tion notice from 1982 that would somewhat date the original examina- <br />tion of that earthern bank and an attempt on the part of the applicant <br />to use the fill along the shoreline. At that nspection the applicant <br />was advised by both Olson and Jacobs to erect a retaining wall to <br />sustain the eroding bank. Prior to the wall construction, Johnson <br />claims the heavy rains would wash mud and sediment down over the now <br />graveled area directly into the lake. The gravel was placed over the <br />area prior to the wall construction. Johnson stated that he would <br />remove the section of wall within the 75' protected area but I <br />suggested he wait for Council's decision. The location of the wall <br />and bank excavation are out of the 75' protected area. It would <br />appear staff had resolved the fill along the Lakeshore in 1982. <br />Planning Commission Recommendation <br />A) Placement of Gravel <br />To deny the after -the -fact hardcover variance application by Karl <br />Johnson, at 3393 Crystal Bay Road based on the following findings: <br />1. No evidence that a driveway ever existed on the Johnson <br />property that served the house to west. <br />2. The gravel as placed and used is considered hardcover. <br />3. Applicant placed hardcover within protected area without the <br />required variances. <br />The recommendation for denial is subject to the following <br />conditions: <br />a. Al 1 hardcover (grave 1 ) within 0-75' setback must he ru-moved <br />and replaced with suitable ground cover. <br />
