performance of the Grantee's sewer shall require Grantee's <br />express written approval, by way of illustration but not <br />limitation such as permeable pavers and stormwater <br />management systems. Grantee shall restore the surface to a <br />comparable condition as existed prior to the Grantee's work, <br />which includes replacing all grass, sod, and bituminous <br />parking surfaces, and lake channel edging surfaces (granite <br />riprap and gravel) within the disturbed portion of the <br />Permanent Sanitary Sewer Easement Area. <br />2. Grantee's Maintenance, Access and Soil Compaction. <br />a. Routine Maintenance. Grantee will perform major, impactful <br />routine maintenance, which by way of illustration and not limitation, <br />includes force main cleaning, during of the period of October 15 to March 30 <br />(the "Off Season"), following the provision of prior written mailed notice <br />provided to Grantor a minimum of seven (7) days prior to commencement of <br />the maintenance as provided in Section 4. During the Off Season, in the <br />performance of routine maintenance activities, Grantee, its employees, <br />contractors and agents may utilize portions of the Property outside of the <br />Permanent Sanitary Sewer Easement Area for parking of vehicles and <br />equipment related maintenance activities. <br />Grantee will perform minor, non-impactful routine maintenance which by <br />way of illustration and not limitation includes changing carbon filtration on <br />the odor control components or air relief valve maintenance of the <br />improvements as needed and provide notice one (1) business day to Grantor <br />via email and telephone. In the performance of minor routine maintenance <br />of the improvements that occur outside of the Off Season, Grantee may utilize <br />two parking stalls which are located over the Grantee's subsurface <br />improvements. <br />b. Emergency Work. In the case of Emergency Work, Grantee shall <br />provide notice as provided in Section 4 as soon as practical. "Emergency <br />Work" is work that requires immediate action to correct or avoid (a) threats <br />or harm to the health and safety of the public, contractors, and/or employees <br />or (b) threats or harm to the Grantee's facilities, Grantee's infrastructure or <br />property. <br />C. Soil Compaction and Restoration.
