shall have 15 business days to review the Improvement Plans <br />to determine if the plans will result in any adverse impacts to <br />the Grantee's facilities located within the Permanent <br />Sanitary Sewer Easement Area ("Review Period"). <br />If Grantee determines the Improvement Plans will not result <br />in any adverse impacts to the Grantee's facilities located <br />within the Permanent Sanitary Sewer Easement Area, <br />Grantee shall provide written approval of the Improvement <br />Plans no later than 15 business days after the Review Period. <br />If the Grantee determines the Improvement Plans will <br />adversely affect the Grantee's facilities located within the <br />Permanent Sanitary Sewer Easement Area, Grantee shall <br />provide written comments stating Grantee's objections to the <br />Improvement Plans and thereafter Grantor and Grantee <br />shall cooperate to attempt to resolve Grantee's objections. <br />Both the Improvement Plans and any Grantee objections <br />shall be based upon reasonable engineering and operational <br />standards applicable to the proposed improvement made by <br />the Improvement Plans. <br />Grantor and Grantee agree to amend this Easement to reflect <br />any improvement constructed pursuant to this <br />paragraph 1 (a) (iv) prior to commencing an approved <br />Improvement Plan. For Grantee -approved Improvements <br />that are disturbed during Grantee's use of the Permanent <br />Sanitary Sewer Easement Area, Grantee shall coordinate in <br />advance with Grantor (except in an emergency when Grantee <br />shall notify Grantor as soon as reasonably practical), identify <br />the Improvements to be removed and a plan for their salvage <br />or replacement. In any event, Grantee's cost of replacement <br />shall be limited to the equivalent cost, at the time of <br />replacement, to construct a bituminous parking surface area, <br />including the subgrade, for the area disturbed by Grantee. <br />Grantor shall also provide plans to Grantee in advance, but <br />Grantee's express written approval is not required, for <br />installation of ordinary bituminous or concrete parking <br />surfaces, streets or roadways, landscaping with minimal <br />subsurface penetration and minimal root system bushes and <br />shrubs, although systems that may adversely impact the <br />3 <br />Project MCES 8567 Forcemain Rep la cement at Channel Crossings <br />Hennepin County Parcel 08.1 17.23,34.0061 <br />3of14 <br />49 <br />
