A involved in Stubbs Bay Road right-of-way. Parcel A will not be <br />involved in a future subdivision of the property. The resolution <br />approving the division has been drafted excluding the request for <br />right-of-way involved in Parcel B. Staff will amend the resolution <br />pending Council's final decision on this matter. <br />Staff will require the customary Conservation & Flowage Easement <br />over the wetlands area within the newly created lot. The City must <br />ask for this now since this parcel can never be subject to division <br />again based on the 9+/- acres of dry lands (10 acres required for lot <br />split). <br />The City must address the issue of the two residences on Parcel <br />B. The second residence cannot be designated as a guest house because <br />it is a rental unit and so should be recognized as a non -conforming <br />use and subject to all pertinent ordinances. The second residence <br />shall become a conforming use at the time of a future subdivision of <br />the property. <br />Planning Commission Recommendation <br />To approve the metes and bounds subdivision of the property <br />located at 3760 Watertown Road for Catharine Cram creating one new <br />residential unit finding all standards of the RR-lA Zoning District <br />have been satsified. Approval of the subdivision is subject to the <br />following conditions: <br />1. Conservation and Flowage Easement over wetlands in Parcel A. <br />2. Payment of Park fee for Parcel A of $100.00. <br />3. Second residence on Parcel B is a non -conforming structure <br />and subject to all pertinent ordinances. <br />4. Based on current RR-lA Zoning standards, Parcel A meets the <br />rural standards for one residential unit. <br />The enclosed resolution has been drafted to incorporate the <br />findings and conditions of approval set forth in the Planning <br />Commission's recommendation. <br />2 <br />
