V OF ORONO <br />Subject: #888 Catharine A. Cram, 3760 Watertown Road - <br />Subdivision <br />Zoning District - RR -IA - 5 acre minimum <br />Area - 80.2 Acres (exclusive of roadways) <br />Application - Subdivision - Metes and Bounds - Lot Division <br />Parcel A <br />Total Area = 10.03 acres (exclusive of roadway but <br />inclusive of wet area) <br />Parcel B <br />Total Area = 73.5 acres (exclusive of roadway) <br />Mrs. Cram has applied for a division of her homestead creating <br />one new residential unit of ten acres. The City does not require <br />septic testing for lots in excess of five acres in area. There is <br />approximately 3/4 to 1 acre of wetlands in the northeast corner of the <br />property. The City will ask for a Flowage & Conservation Easement <br />over that portion of the wetlands located within Parcel A. <br />A 50' wide corridor has been created providing access to the new <br />lot via Stubbs Bay Road. Note that sections of the Cram property run <br />to the center and at points over the entire designated rights -of -way <br />of Stubbs Bay and Watertown Roads. Since we are dealing with a metes <br />and bounds division, the City would ask for dedication of right-of-way <br />via a quit claim deed. The question arose during the Planning Commis- <br />sion review if the City would be creating a separate par •nl of 20+/- <br />acres on the south side of Watertown Road by asking for quit claim <br />deeds over the entire 66' of Watertown right-of-way. Staff reviewed <br />the question with both Rolf Ericson and Dennis Hill of Hennepin <br />County. Both agreed that the City's resolution controls the numl-er of <br />parcels created in the metes and bounds division. The City may ask <br />for the quit claim deed deeding the complete 66 feet of right-of-way <br />for Watertown and not create the additional 20+ acre lot on the south <br />side of Watertown. Mrs. Cram has met with staff and has been advised <br />of these findings. <br />Planning Commission asked the City to reconsider the request for <br />right-of-way dedications via quit claim deeds in subdivisions that <br />create one parcel of 5+ acres. A future division of this property <br />would require a formal plat - the additional right-of-way can be <br />dedicated to the public use at that time. Mark Gronberg, surveyor for <br />Mrs. Cram, advised that the metes and bounds descriptions for this <br />specific quit claim deed would be 4 to 5 pages long. The City must <br />ask for the quit claim deed of right-of-way for that portion of Parcel <br />
