He requests a variance to the size standard <br />because he claims that at least two of his immediate neighbors have <br />boats over 20 feet in length stored in their yards. (Note areas <br />designated as 2 & 7 on staff survey - Exhibit E.) In addition, he <br />calls attention to the "numerous boats stored on private property <br />throughout the City of Orono". The applicants consider staff's ac- <br />tions highly discriminatory in singling them out for actions deemed <br />appropriate, natural and completely acceptable on other neighbors' <br />lots and in other neighborhoods throughout the City. <br />A second variance to the exterior storage section is sought by <br />applicant claiming there is no other area on the property to store the <br />boat because of the sloping topography. The boat is stored less than <br />35' from Pleasant Road and possibly less then 10' from the side <br />property line - survey does not confirm setbacks. The ordinance <br />allows a boat of less than 20 feet in length stored in a rear yard 10 <br />feet from property lines. Council agreed that a boat in excess of 20 <br />feet can be stored on a lakeshore lot if it is adquately screened or <br />stored in a building --- and if neighbors have no sight problems. <br />Per Section 10.02 Item 79 - Yard, Rear. -- On a lakeshore lot, the <br />rear yard shall be the yard which fronts on the street lying between <br />the streetline of the lot and the required rear yard setback line. A <br />boat less than 20 feet in length could be stored in the rear yard. <br />Our applicant has 2 street yards - rear/street and side/street yards. <br />The applicant's boat is stored in what effectively is the extended <br />
