Long Lake Creek <br />Staff reviewed the classification data used to determine these <br />designations last year and concurred with the DNR findings. Review <br />the classification list (Exhibit A) and the information sheets <br />(Exhibit D) that review the various standards, measurements and <br />criteria used to determine the classification of each of the above <br />lakes. <br />Our City was given a one year deadline to complete the necessary <br />ordinance amendment. The DNR will expect the City to complete the <br />ordinance review sometime this year. I have been advised that I can <br />apply for an extension if necessary. <br />For our City, the process will involve the amendment of Section <br />10.55 to include a shoreland overlay district that would govern future <br />development of all land within 1000 feet of the lakes specified above <br />and within 300 feet of rivers and streams. In the process of amending <br />Section 10.55, staff suggests a review of the existing wetlands and <br />flood plain sections to determine if them are omissions or a need to <br />clarify or expand. <br />Staff recommends altering Section 10.55, Subdivision 8, Develop- <br />ment Restricted; Prohibition, to delete the 26 feet setback from flood <br />plain elevation. A flood plain and wetlands area are two different <br />entities. Flood plains can be grassed lawns, brush and treed areas - <br />they do not serve to filter run-off as a wetlands. If there are <br />wetlands within a f lood plain then the wetlands setback of 26 feet <br />will apply. <br />Review Exhibits A & B, the classification list and the suggested <br />model ordinance (specifically Page 6) - Staff notes the following: <br />1. Residence on R.D. Lakes - Mooney, Tanager and Long which meet <br />current 75' structure setback would become non -conforming. <br />2. Structures and septic systems on NE lakes - French Lake, <br />Lydiard, Dickey and Classc,, - which meet the current 75 feet <br />setback would become non -conforming. <br />3. Orono is more retrictive in required lot sizes. <br />4. Our setbacks from County roads in urban areas are less <br />retrictive. <br />5. May have to review our hardcover standards with DNR's 30% <br />maximum. <br />6. DNR must review all variances to shoreland regulations; all <br />plats that are inconsistent with shoreland regulations must be <br />
