Mabusth, Zoning Administrator <br />Gi _ `r OF ORONO <br />Date: March 7, 1985 <br />Subject: Proposed Amendment of Section 10.55, Flood Plain and <br />Wetlands Management Ordinance <br />List of Exhibits <br />Exhibit A - Classification List <br />Exhibit B - Model Ordinance <br />Exhibit C - Amendment of M.S. 105.485 - Adopted 1973 <br />Exhibit D - Support Information on Classification Criteria <br />A) Status of Review <br />A public hearing was held by the Planning Commission on February <br />19th to review an ordinance amendment proposed by the DNR, agency <br />authorized by state law in 1973 to establish standards and criteria <br />for municipal shoreland development. Shorelands include land within <br />1000 feet of a lake or 300 feet from a river or stream. <br />The purpose of the preliminary review hearing was to review the <br />amendment and discuss the impact on the current code in addition to <br />making any necessary amendments to current 10.55 code. The Planning <br />Commission felt the impact of the proposed ordinance changes and <br />potential conflict with another govermental agency having concurrent <br />jurisdiction over all shoreland within the City so important an issue <br />that the matter be best addressed at a joint meeting of both bodies. <br />The Planning Commission questioned the authority of the DNR to impose <br />these additional regulations and the added expenses passed on to our <br />residents in dealing with yet another bureaucracy. <br />B) Discussion and Background on Proposed Amendment (Exhibit B) <br />The City is required by State Law to adopt an ordinance to assure <br />wise development and use of the shorelands of certain protected waters <br />within the City that have been given a shoreland management classifi- <br />cation. <br />These protected waters of the City have been classified by the <br />Commissioner of Natural Resources as follows: <br />A) Natural Environment Lakes <br />1. French Lake Marsh <br />2. Lydiard <br />3. Dickey <br />4. Classen <br />B) Recreational Development Lakes <br />1. Mooney <br />2. Tanager <br />
