City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />1712 <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE SECTION 10.20, SUBD 3(E) - FILE NO. 880 <br />WHEREAS, Steven Ruce (hereinafter "the applicant") is the <br />owner of the property located at 4625 Wrest Branch Road located within <br />the City of Orono (hereinafter "the City") and legally described as <br />follows: <br />The north 208 and 71/100 feet of the East 208 and 71/100 feet <br />of the Northwest 1/4 of the Northwest 1/4 of Section 7, <br />Township 117 North Range 23 West. (hereinafter <br />"property"); and <br />WHEREAS, the applicant has applied to the City for a <br />Conditional Use Permit to permit the use of an attached 10' x 25' <br />greenhouse for commercial purposes per Municipal Zoning Code Section <br />10.20, Subdivision 3(E). <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />Findings <br />1. The application was reviewed as Zoning File No. 880. <br />2. The property is located in the RR-lB Single Family Rural <br />Residential Zoning District. <br />3. On November 19, 1984, the Orono Planning Commission reviewed <br />the application as proposed and recommended approval, f inding <br />that no retail sales activity is proposed to take place on the <br />property, that no setback variances would be required, no <br />addi tional traf f is to or from the property would be created, <br />and the proposal would have no effect on the septic system, <br />subject to the condition that the structure conform to all <br />pertinent sections of the Building Code. <br />4. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by staff and comments of the applicant and the effect <br />of the proposed use on the health, safety and welfare of the <br />community. <br />Page 1 of 4 <br />
