ORDINANCE NUMBER 9, SECOND SERIES <br />AN ORDINANCE AMENDING PERFORMANCE STANDARDS TO THE <br />NON -ENCROACHMENT AND ACCESSORY STRUCTURE SECTIONS OF THE ORONO <br />MUNICIPAL CODE <br />The City Council of Orono Ordains As Follows: <br />SECTION 1. Chapter 10 of the Municipal Code of Orono is <br />hereby amended by amending Sections 10.03 Subdivision 15(C), (7), <br />(E), (F) and 10.22 Subdivision 1 to read as follows: <br />SECTION 10.03 <br />Subdivision 15 Non -Encroachments <br />C. Fences which do not exceed 3-1/2 feet in height, fences not <br />over six feet in height along the street lot line of lake <br />frontage lots which front on a major thoroughfare, if fi l l is <br />required, the total combined height of both fence and fill shall <br />not exceed b feet above the height of the crown of the road, <br />terraces, steps, uncovered porches, stoops or similar structures, <br />which do not extend above the height of the ground floor level of <br />the principal building and extend to a distance of not less than <br />two feet from any lot line. <br />D. In side or rear yards only, bays not to exceed a depth of two <br />feet nor to coW-ain an area of more than twenty square feet, fire <br />escapes not to exceed a width of three feet, fences and walls not <br />to exceed a height of six feet above existing grade and open off <br />street parking ex,--ept for Lakeshore lots, no fence or wall o�:e <br />�o Tty-two inch�u�ot in excess of seventy - two inches in <br />heig above �e may belocate closer to the <br />shoreline than the average distance from the shoreline of <br />existing residence buildings on adjacent lots, such fences shall <br />not be constructed within 75 feet of the shoreline. <br />E. Rear yard only; balconies, breezeways, detached outdoor <br />picnic shelters and recreational equipment except as regulated <br />hereinafter; no accessory structure shall be closer than five <br />feet from a rear lot line nor spa fence or wall constructed <br />within a rear yard exceed a height of six feet above existiT,ig <br />g r a e. <br />F. Side yards only; no accessory structure shall be closer than <br />ten feet from any side lot line nor shall a fe�or wall <br />nstructed within a side yard exceed height of six feet above <br />exis ITng gra e. <br />SECTION 19.22.
