Mabusth, Zoning Administratuc <br />DATE: January 7, 1985 <br />SUBJECT: Proposed Amendment of Zoning Code - Placing Limitations <br />on Fill, Locations and Height of Privacy Fences Within <br />the City <br />Public Hearing field on October 22, 1984 by the Planning <br />Commission <br />Amendments are proposed to the following sections: <br />1. Section 10.03, Subdivision 1.5(C) non -encroachment section <br />2. Section 10.03, Subdivision 9(B) height of accessory building <br />and structures. <br />Section 10.22 Subdivision 1 lakeshore setback rr_gulatlons. <br />4. Section 10.01, Subdivision 15(D) non -encroachment section. <br />The enclosed ordinance places limitations on the amount of fill <br />allowed in conjunction with the installation of a privacy fence <br />along a major thoroughfare as long as the combined height does <br />not exceed 6 feet above the height of the crown of that roaoway. <br />Limitations are now placed on the height of privacy fences <br />allowed per the accessory structure code. Such privacy fences <br />are limited to 6 feet in height measured at existing grade - no <br />f i l l ing al lowed. Variances wi 1 1 l e sought if there are unique <br />hardships related to a property. The current code places; no <br />realistic height restrictions (except for 30 feet maximum height) <br />Of) i✓acy fences that maintain ac,---ssory structure setbacks in <br />rear, side and Lakeshore yards. <br />,he Planning Commission unanimously recommmends against the <br />placement of 6 feet privacy fences at the 75 feet lakeshore <br />setback line. They strongly suggest a placement based or the <br />average lakeshore setback of the homes on adjacent lots. The <br />enclosed ordinance has been drafted to include the Planning <br />Commission recommendation. <br />'f an average setback is established for privacy fence <br />construct-d '0 feet from a side lot line (as an accessory <br />structure), staff recommends also amending the non -encroachment <br />section of the code that allows 6 feat high fences up to the <br />front line of a house on a Iakesh;rf-= lot with no required <br />setbacks from _he side lot line. <br />
