A residence is classified as a <br />boarding house if 3 or more unrelated persons are provided meals <br />or lodging for compensation - note that the number of persons <br />serviced is limited to eight under this classfication. A family <br />unit is also defined in the code ". . . .a group of not more than <br />four persons not related maintaining a common household." Staff <br />has used this section of the code as a guide for owners of houses <br />put up as rental properties. I would safely venture that there <br />are rental properties throughout the City where there are more <br />than four unrelated renters - especially true for the larger, <br />older homes within the City. <br />Kaul's proposed use and brief review of the property: <br />The subject property is the former Alden Anderson homestead. <br />In 1981, the City denied Anderson's variance application that <br />proposed the separation of his substandarn rural lots. The code <br />requires four acres of dry contiguous land; the property contains <br />approximately 3.3 acres of dry contiguous land. Since that <br />variance review the Andersons have moved out of the house -- the <br />house has been vacant for over a year and a half. The Andersons <br />have had the house offered for sale for at least three years. <br />Reports from persons seeking information on the property confirm <br />the house will require major repairs if it is to remain in its <br />present state and not be torn down. <br />Kau l's B&B will provide 5 lodging rooms with a limit of 2 <br />persons per room for a maximum use level at 10 persons. Meals <br />will not be served except for a "Continental Breakfast". Guests <br />wi 1 1 not be allowed to use their residential dock for boating. <br />The nearby marina, Sailors World, will serve all gue-I s. The <br />dock wi 1 1 be used by their guests for swimming, fishing and sight <br />seeing. The grounds and porch area will be used by guests. Lawn <br />games such as croquet will be provided. Guests of a B&B usually <br />arrive in late afternoon and leave after breakfast the next day. <br />There is no commercial signage planned as guests of B&Bs are <br />referred via a special statewide B&B directory. B&B owners do <br />not advertise in local papers. I have been advised by tr "duls <br />that a B&B operates in Minnetonka Beach - neighbors and City <br />are not aware of its existence. <br />Parking spaces will be provided on the property to the rear <br />of the property and out of site from passerbys and neighboring <br />property owners. <br />The applicants have provided abundant information on B&B <br />operations for your review. First and foremost they want Council <br />to know that the house and grounds will serve primarily as their <br />home and special place to raise their young family. <br />Review of proposed use and performance standards of Home <br />Occupation: <br />1. Use is carried on only by persons residing in residence --the <br />r.auls advise that Mrs. Kaul will be the only person involved <br />
